Before accessing and using the website epictipz.com, please read these General Terms and Conditions ("Terms and Conditions") carefully.

Definitions

  • "Tip": A payment transaction initiated by a Tipper to a Creator via the EPICTIPZ Platform, where the Tipper acts as the Payer and the Creator as the Payee.
  • "Payment Service Provider": Any entity authorised to process Debit or Credit Card payments for a Tip or to provide Payment Services as defined in Annex I of Directive (EU) 2015/2366 of the European Parliament and of the Council dated 25 November 2015 on payment services in the internal market, including amendments and repeals to previous directives and regulations.
  • "Payment Services": Services outlined in Annex I of Directive (EU) 2015/2366 concerning payment services in the internal market, as amended.

Introduction

BEEVER INNOVATION LIMITED, a company incorporated under the laws of the Republic of Ireland, with registration number 774573, and registered office at Alexandra House, The Sweepstakes, Ballbridge, D04 C7H2 Dublin, Ireland ("EPICTIPZ," "we," "us," "our")

EPICTIPZ has developed the EPICTIPZ Platform ("Platform"), enabling users within the European Economic Area to send tips to their favorite Creators via a tipping link.

To process payment transactions on the Platform, EPICTIPZ has partnered with external payment service providers ("Payment Service Providers") that execute payment services transactions requested by the Consumer on the Platform.

These Terms and Conditions govern your use of the Platform as a user ("Consumer," "you," "your"). By sending a Tip as a Tipper, you accept these Terms and Conditions. You may also engage in payment transactions on the Platform, integrated with Payment Service Providers' solutions offering you Payment Services. Together with EPICTIPZ's Privacy Policy ("Privacy Policy"), these Terms and Conditions form a legal agreement ("Agreement") between you and EPICTIPZ.

Accessing the EPICTIPZ web portal requires an internet connection and a compatible device (computer, smartphone, or tablet with a web browser). Information about compatible operating systems and browsers is available at www.EPICTIPZ.com.

You may use the Platform solely for personal purposes and in accordance with this Agreement. The Agreement is of indefinite duration and remains effective until terminated by you or EPICTIPZ as outlined herein.

All communications and the Agreement are conducted in English unless otherwise specified. You can download a copy of these Terms and Conditions from the Platform or request one from Customer Support at any time.

Accessing and Using the Platform as a Tipper

To use the Platform as a Tipper (i.e., to send tips to Creators), you must:

  1. Be an individual acting in a private capacity.
  2. Be at least eighteen (18) years old.
  3. Have a valid email address.
  4. Possess one of the payment methods listed in section 3.1.3 below.
  5. Not be listed on or associated with any sanctions lists, including those of the EU, UN, or OFAC.
  6. Accept these Terms and Conditions and the Terms of Use/Service of the relevant Payment Service Provider used to process your Tip transaction.

To send a Tip to a Creator, click on the EPICTIPZ Tipping Link ("Tipping Link") provided by the Creator and follow the payment instructions.

You may choose from the following payment methods to execute a Tip transaction:

  • Credit/Debit Card
  • Open Banking
  • Cryptocurrency payment

By using the Platform as a Tipper to send Tips, you acknowledge and agree that:

  • EPICTIPZ is not responsible for any statements, advertisements, or instructions provided by Creators regarding the EPICTIPZ Platform or Tipping Links.
  • When you execute a Tipping transaction, you are purchasing a digital good from EPICTIPZ, representing your contribution sent to the Creator you tipped (fees may apply).
  • You are solely responsible for determining and handling any taxes applicable to your transactions, including withholding, collecting, reporting, and remitting the correct amounts to the appropriate tax authorities.
  • EPICTIPZ is not responsible for determining or managing any taxes related to your Tips.
  • All Tipping payment transactions are processed by a Payment Service Provider; therefore, the Terms of Use/Service of the relevant Payment Service Provider apply to these transactions.

Digital Goods

Each tipping transaction on EPICTIPZ results in your purchase of a digital good sold by EPICTIPZ. Digital goods may include content such as images, GIFs, emojis, or videos.

The digital goods you purchase when tipping a Creator will be delivered to the email address you provided in the Tipping Link interface.

Fees and Charges

Fees are applied to tips on the Platform (i.e., the sale of digital goods when executing a Tip to a Creator).

  • Tipping Fees: These fees are deducted from the Tip sent to the Creator and are disclosed on the final payment confirmation page of the Tipping Link interface

The Tipping Fees are automatically withheld by EPICTIPZ from the amount paid to the Creator upon execution of the Tip. For example, if you wish to tip a Creator €10, you will pay €10, and the fees will be deducted before the Tip is forwarded to the Creator.

Refunds and Chargebacks

  • Refund: The return of any amount you paid, resulting in the cancellation of the corresponding Tipping transaction, either in part or in full. Tips executed on EPICTIPZ are non-refundable unless EPICTIPZ agrees otherwise with you in writing on an exceptional basis.
  • Chargeback: The return of funds to your Credit or Debit Card account after disputing a card payment on your statement. Chargebacks may occur in cases where you dispute a transaction where you paid a Tip to a Creator on EPICTIPZ using a Credit or Debit Card. Chargebacks are subject to your bank's or card provider's Terms of Service. EPICTIPZ will cooperate with your bank or card provider to process approved Chargeback requests effectively.

Customer Support and Complaints

EPICTIPZ offers customer support services related to the Platform and the Tips executed through it ("Customer Support"). You can contact Customer Support with any questions about the Platform via email at support@epictipz.com. Support is available from 10:00 to 16:00 CET on Irish banking days and is provided in English.

Please note that Customer Support serves as a first line of support and may need to engage EPICTIPZ or other partners for additional assistance as necessary.

For complaints or claims regarding Creators you have tipped, please contact the Creator directly. Creators are responsible for any statements or disclosures they make concerning the receipt of Tips, in accordance with applicable laws. Neither EPICTIPZ nor Payment Service Providers assume liability for such statements or disclosures.

Your Personal Data

EPICTIPZ collects and processes personal data about you to provide the Platform. EPICTIPZ is the data controller for personal data processed for Tips on the Platform and for Customer Support

EPICTIPZ is committed to keeping your personal data safe and secure. Your information will not be disclosed to third parties outside of EPICTIPZ's trusted suppliers involved in providing the Platform, except as required by Irish law or applicable EU legislation.

Understanding how EPICTIPZ processes your personal data is important. EPICTIPZ values your privacy and handles personal data in compliance with the General Data Protection Regulation (GDPR). Please refer to EPICTIPZ's Privacy Policy for detailed information on the personal data collected, its usage, security measures, and retention periods.

Modifying the Agreement and Termination

EPICTIPZ may unilaterally amend the Agreement (including these Terms and Conditions or the Privacy Policy) from time to time, for reasons such as introducing new features or complying with legal requirements.

As a Tipper, we recommend reviewing these Terms and Conditions thoroughly before engaging in any Tipping transactions on the Platform. Since no account maintenance is required to execute Tips, you may discontinue using the Platform at any time without notice or charge.

EPICTIPZ may, at its discretion:

  1. Suspend your use of the Platform (or any part of it), or
  2. Terminate the Agreement and your access to the Platform (or any part of it) immediately if you materially breach the Agreement or any applicable laws, or if required by law, regulation, court order, or authority request.

Additional Legal Terms

  • Changes to the Platform: EPICTIPZ may make changes, updates, or upgrades to the Platform as needed. You will be notified in advance of significant changes.
  • Intellectual Property Rights: By entering into this Agreement, EPICTIPZ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use the Platform. All intellectual property rights in the Platform belong to EPICTIPZ or its licensors, including logos, designs, content, software, source code, trademarks, know-how, and data. You are not permitted to use EPICTIPZ's or its licensors' names, trademarks, logos, or other intellectual property beyond what is allowed in this Agreement. You must not copy, reproduce, modify, reverse engineer, or disassemble any of EPICTIPZ's products, services, or intellectual property.
  • EPICTIPZ's Liability: The Platform is provided "as is," and EPICTIPZ does not guarantee it will be free from faults or interruptions, partly because third parties are involved in its provision.
  • Liability Exclusions: To the extent permitted by law, EPICTIPZ is not liable for:
  1. Indirect, punitive, or consequential damages, including loss of profit, data, business, goodwill, or reputation.
  2. Damages arising from compliance with laws, regulations, court orders, or regulatory requirements
  3. Damages due to delays, interruptions, faults, or inaccuracies related to the Platform.
  4. Damages caused by viruses, malware, phishing, or other harmful material affecting your IT equipment.
  5. Unauthorized transactions, except as specified in these Terms and Conditions.
  6. Actions by Payment Service Providers to reject, freeze, or block transactions.
  7. Fraudulent acts by third parties posing as EPICTIPZ or related entities to obtain your customer details.
  8. Any tax obligations related to Tipping transactions executed on the Platform.
  • Force Majeure: EPICTIPZ is not liable for failures or delays caused by events beyond its reasonable control ("force majeure events"), such as natural disasters, wars, civil disturbances, terrorism, strikes, epidemics, or pandemics. In such cases, EPICTIPZ will notify you and be excused from affected obligations during the event's duration.
  • Severability: If any provision of the Agreement is deemed invalid or unenforceable, the remaining provisions remain in effect.
  • Assignment: You may not assign your rights or obligations under the Agreement to any third party. EPICTIPZ may assign its rights or obligations to an affiliated company or third party without your consent.
  • No Waiver: EPICTIPZ's delay or failure to exercise any right or remedy does not constitute a waiver of that or any other right or remedy.
  • Governing Law: The Agreement is governed by the laws of the Republic of Ireland, excluding its conflict of law principles.
  • Dispute Resolution: If you have complaints or disputes with EPICTIPZ, please contact Customer Support. For information about your consumer rights or to file a formal complaint, visit the Irish Consumer Authority's website at https://www.ccpc.ie/consumers/shopping/. You may also use the EU's online dispute resolution platform at https://ec.europa.eu/consumers/odr/main/?event=main.trader.register. If legal action is taken against you by EPICTIPZ, the courts of the Republic of Ireland have jurisdiction. EPICTIPZ reserves the right to initiate legal proceedings in other countries if you reside or hold assets there.
  • Irish Consumer Rights Act: Under the Irish Consumer Rights Act, you have the right to withdraw from distance agreements. However, when purchasing digital goods on EPICTIPZ, you expressly consent to immediate delivery in a digital format upon purchase validation, waiving your withdrawal right. Therefore, purchases made through EPICTIPZ are exempt from withdrawal rights under the Consumer Rights Act.

By using the EPICTIPZ Platform and sending Tips, you agree to these Terms and Conditions.
